State, federal, and local employment laws prohibit discrimination based upon an individual’s race or skin color. This prohibition includes intentional harassment or discrimination (disparate treatment, racial slurs and epithets), unintentional discrimination (i.e. policies or practices that have a statistically measurable adverse effect on individuals of a specific race), and reverse
discrimination. Under these laws, judgments arising from race discrimination lawsuits can include penalties, liquidated damages, and payment of the plaintiff’s attorney fees.
Last year, the U.S. Equal Employment Opportunity Commission (EEOC) announced that the number of employment discrimination complaints filed with the agency has reached record levels. Race discrimination claims are
the most frequently filed employment discrimination complaint in the U.S., accounting for more than 1/3rd of all charges. In response to this trend, the EEOC launched a five-year “E-RACE” initiative intended to promote racial and
cultural diversity in the workplace, increase employee awareness of their legal protections, and aggressively enforce racially-motivated discrimination claims.

In July of 2009, President Barack Obama announced that he will nominate Jacqueline Berrien, an attorney for the NAACP who has significant experience on cases involving race or color bias, as the new head of the EEOC. If confirmed, Berrien is expected to enact an aggressive enforcement strategy for the agency.

To help employers meet their obligations under applicable laws, prevent costly employee lawsuits, and address the recent rise in racial discrimination charges, Personnel Concepts has developed this comprehensive policy poster that can alert applicants and employees alike to your commitment to racial equality in hiring and employment.
