“Workplace violence” is defined as an act of aggression or the threat of physical violence against workers on the job. It can occur in, at, or outside the workplace, and can range from threats and verbal abuse to physical assaults and homicide. Over 2 million Americans are victims of workplace violence each year. Each week in the United States, an average of 33,000 workers are assaulted on the job and 17 are murdered. Employers pay close to $40 billion annually in direct and indirect costs associated with these incidents.

OSHA’s General Duty Clause (29 USC 654, Sec. 5(a)) requires employers to provide a form of employment and place of employment free from recognized hazards likely to cause injury or death. Since workplace violence can strike anywhere at any time, every employer is obligated to address the threat of workplace violence by implementing appropriate safeguards and safety training. Failure to protect employees from violence in the workplace can result in fines and penalties under the General Duty Clause of the OSH Act and/or related state regulations.
